Online: How To Issue And Make Criminal Record Certificate from Luxembourg Valid

 Well, I do know that it is a small country but I didn’t know that!


 


Luxembourg is surrounded by Belgium, Germany and France whose GDPs occupy more than a half of entire European GDP. Thanks to this perfect location, there are a large number of people from these countries working in Luxembourg contributing Luxembourg being the second richest country in the world with high GDP! Following this, it is a matter of course that Luxembourg is one of the best countries to live in with a good level of welfare, good quality of education and so on.


Also it is, of course, that there are lots of immigrants or students from other countries in Luxembourg. Today I am going to tell you some important information that might be needed if you are to live in Luxembourg for long.

  Criminal record certificate(Certificat casier judiciaire) is a document showing if a person has been convicted in the past or not. Thus criminal record certificate from Luxembourg confirms whether a person has criminal records or not while in Luxembourg for people who have stayed in Luxembourg for at least 6 months. This document is asked in a frequent basis in the situation like issuing or renewing visa, enrolling a school, getting a job or marriage and etc. To put it simple and straight, the document is one of the essential document while you are to settle down in Luxembourg. Also this document is often required if you left Luxembourg. So attention! 


  To get this document, you can request it either offline or online. For offline, you visit the Criminal Records Department(Service du casier judiciaire) in Luxembourg city in person. However, due to the spread of COVID-19, the department is closed so you can only request online. For online, you can email to casier.judiciare@justice.etat.lu with an identity card or passport or residence permit. Or you can apply it via MyGuichet.lu (See Forms/Online Services on this page) with a scanned copy of the concerned person’s identity card and a power of attorney if the applicant is a third party. If the application is duly signed, then it will be forwarded to the Criminal Records Department.


  This document is only available for any natural person over 18 years of age who is a Luxembourg national or resides in Luxembourg including foreigners in Luxembourg. Plus, the charge of applying the criminal record certificate is free and the document will be issued in France. 


  If you are to use this document in Luxembourg, you can use the document right away but if you are to use outside of Luxembourg, the document itself is not valid. It is no surprise at all considering that it is a matter between two different countries, Luxembourg and a submit country. Before use the document in a foreign country, you should process three more steps. 



  Firstly, you should translate all the French in the document into the language which the submit country uses as official. Though you are good at the language, you should get the translation done by a professional translator unless you will be denied in the next step. Plus, If the country admits French as official, you can jump over this step. 


  Secondly, you should notarize the translation. This step is to confirm the translation matches with the original, so that the translation is reliable. Though you jump the previous step in the reason that submit country uses French, you cannot leave out notarization. Moreover, like the previous step, this step ought to be done by a professional notary lawyer. 


  Thirdly, you should certify that the document is genuine and legal, so called ‘legalization’. To legalize there are two ways, apostille and embassy attestation. Apostille is getting a certification from the issuing country while embassy attestation requires a reconfirmation on that certification from the receiving country. In other words, apostille is easier to process. But you can’t choose. Apostille is only available when the two countries both agree to Hague Convention. 


  For the matter of using criminal certificate from Luxembourg in a foreign country, since Luxembourg is a member of the Convention whether you do apostille or embassy attestation depends on the Submit country. If the other country joins you do apostille and if not you do embassy attestation. 


  However, just like our lives do, there is a tradeoff. Apostille is easy and simple but there is one thing to be careful. Apostille is only available when only in the country which issue the document. Thus if you are outside for Luxembourg and forget to get apostille, there is no other way to make it on your own. Instead, you can get apostille by looking for a delegate in Luxembourg. However, this is too tough for a person to handle without professionals. Think about writing the power of attorney and also getting this document translated, notarized and apostille!
